Website Terms of Use
These Terms of Use govern your access to hunkapiservices.org, which is operated by Hunkapi Programs, Inc. (“HŪNKAPI,” “we,” “us,” or “our”). If you do not agree, please do not use the site.
Information only; no professional relationship
Website content is general information about HŪNKAPI programs and is not medical, mental-health, legal, financial, or other professional advice. Viewing the site or submitting a request does not create a therapist-client, provider-patient, instructor-participant, fiduciary, or other professional relationship and does not guarantee eligibility, placement, scheduling, funding, or admission to a program.
Not an emergency service
Program information and availability
Programs, staff, formats, eligibility criteria, schedules, pricing, insurance participation, scholarships, and availability may change. HŪNKAPI may determine that a program is not appropriate for a particular person or may recommend another resource. Information provided by intake staff and signed program documents controls over general website content if there is a conflict.
Requests submitted through the site
You agree to provide information that is accurate to the best of your knowledge and that you are at least 18 years old. If you contact HŪNKAPI for a minor or another person, you represent that you are authorized to do so. Do not send unlawful content, medical records, insurance identifiers, Social Security numbers, or other highly sensitive information through ordinary email. Our Website Privacy Notice explains how website information is handled.
Participation and equine activities
Participation in HŪNKAPI programs may involve horses, farm animals, outdoor conditions, physical activity, and other inherent risks. Website use does not authorize participation. Before participating, individuals may be required to complete intake, eligibility, consent, acknowledgment, release, safety, and other program-specific documents. These Terms do not replace those documents and do not waive any right or responsibility that cannot lawfully be waived.
Acceptable use
You may use the site only for lawful, personal, or legitimate organizational purposes. You may not attempt to disrupt the site, bypass security, introduce malicious code, scrape personal information, impersonate another person, submit fraudulent requests, or use content in a way that infringes another person’s rights.
Intellectual property
Unless otherwise stated, the site’s text, branding, design, graphics, and other content are owned by or licensed to HŪNKAPI and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal, noncommercial use. No other license is granted without written permission.
Third-party links
Links to third-party websites or services are provided for convenience. HŪNKAPI does not control and is not responsible for their content, security, availability, or practices. Use of a third-party service is subject to that service’s terms and privacy notice.
Disclaimers
To the fullest extent permitted by law, the site is provided “as is” and “as available.” We do not warrant that every statement will remain current, that the site will be uninterrupted or error-free, or that it will meet every user’s needs. Nothing in these Terms limits obligations or rights that cannot be limited under applicable law.
Limitation of liability
To the fullest extent permitted by law, HŪNKAPI and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to use, this website. This limitation does not apply where prohibited by law and does not govern claims arising from participation in a HŪNKAPI program, which are addressed by applicable law and program-specific agreements.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute concerning only website use will be brought in a court of competent jurisdiction in Maricopa County, Arizona, unless applicable law requires otherwise.
Changes and severability
We may update these Terms by posting a revised version and changing the effective date. If any provision is found unenforceable, the remaining provisions will continue in effect.
